As a result of the committee’s finding the protest was upheld. The placings then read:
1st No.8 Bonny Heights
2nd No.3 Arandom
3rd No.11 Permesso
4th No.2 Ready Eddie
The committee authorised payment of dividends and prize money on the amended placings.
Facts:
Following the running of race 9 Information A4078 was filed with the Judicial Committee. The Information stated that Arandom (placed 1st by the judge) interfered with the chances of Bonny Heights (placed 2nd by the Judge) over the final stages.
The Judge's placings were:
1st No.3 Arandom
2nd No.8 Bonny Heights
3rd No.11 Permesso
4th No.2 Ready Eddie
Rule 642 states:
If a placed horse or it’s rider causes interference within the meaning of this Rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.
All connections present acknowledged that they understood the rule.

Mr Parkes the rider of the second placed horse Bonny heights said that Mr Dee on Arandom came up on his inside when riding vigorously and that his horse shifted out and lent on Bonny heights for several strides and in the heavy going this had an effect on his horse’s chances as the margin was only a short head. He said that whilst he did not have to stop riding out, his horse became unbalanced. Mr Parkes said that he firmly believed that he should have won the race. In answer to a question from the chair Mr Parkes said that just prior to the interference occurring his mount had gained a head advantage over Arandom but that he lost that margin due to the subsequent interference and added that it is harder to get a horse going again in heavy going. All films were then shown with Mr Parkes identifying the points that he had made.
Mr Auret the trainer of Bonny Heights said that he could not add a great deal except to say that interference had occurred to his horse and that she had been pushed out and that it would have affected her chances particularly in the heavy going. He invited the committee to look at the mown strips to ascertain how far his horse had been pushed out.
Mr K Harrison representing the connections of the first placed horse Arandom said that early in the run home Bonny Heights had shifted in towards Arandom, he said that Mr Dee stopped riding first and that really Mr Parkes had not stopped riding at all. He said that he believed that both horses had shifted a fraction and that Arandom was going the better and was going to win the race regardless of what had happened.
Mr Dee the rider of the first placed horse Arandom said that in relation to the incident early in the run home the only thing that happened was that his and Mr Parkes riding boots touched, and that when he went for the whip his mount shifted out, he then stopped using the whip which resulted in his mount losing a little ground as well, and that over the final stages his mount finished over the top of Bonny Heights.
When invited to comment Mr Neal said that with respect to Mr Harrison’s evidence regarding interference early in the straight, that although Bonny Heights did shift in there was not any contact between the two horses. He said that what was of relevance was that near the 100m Bonny Heights had made the lead then that advantage was extinguished due to the interference from Arandom. He added that whilst Mr Parkes did not stop riding, his mount was put off balance and hampered for a short distance; he added that taking into account the short-head margin the Stewards believed that the protest did have some merit.
Reasons for Decision:
The committee found that inside the 200m Arandom did shift out into the rightful running line of Bonny Heights making contact with that horse and continued to layout for some distance. As a consequence Bonny Heights was put off balance and lost some momentum, but continued to finish strongly to the line with only a short head separating the two horses. Following careful consideration of all matters pertaining to the protest, the committee was comfortably satisfied that had interference not occurred that Bonny Heights would have beaten Arandom.
