Decision:

After viewing the videos we are satisfied Mr Beck is in breach of the Rule. The breach is found proved.

Penalty:

Mr Beck is fined $300.

Facts:

Following the running of the Southern Belle Mares Speed Series Final Mobile Pace Stewards lodged an Information alleging Mr Beck (BETTOR ENFORCE) used his whip in an excessive manner over the final 400m.
 
Rule 869 (2) (a) reads
No horseman shall during any race:
(a) use his whip in an unnecessary, excessive or improper manner.

 
The Whip Guidelines read:
Stewards deem the “use of the whip” throughout the race as listed below:
Free of the rein
On the horse itself
On the sulky or dust sheet
Back handers
Excessive use of the whip simply means “too much” and relates to the number of times and/or force with which the whip is used. The whip shall not be used more than 10 times in the last 400m of a race, otherwise this will be deemed excessive use pursuant to these Guidelines

 
Mr Beck did not attend the hearing but admitted the breach of the Rule. He indicated, in writing, on the information he accepted he had struck the horse 13 times.
 
Mr Wallis, with the aid of the video replays, outlined the relevant position of Bettor Enforce as the field rounded the final turn. He said Mr Beck was three deep on the pole line and improving his position. He was observed to strike the horse 13 times, all with back handers. He said this was excessive and in breach of the Rule.

Submissions for Penalty:

Mr Wallis submitted that Mr Beck had admitted the breach, had an excellent record and that it was a first offence since the new Guidelines were introduced. Mr Beck had 191 drives last season and 113 drives in the current season. He sought a fine of $300.
 
Mr Beck made no specific submissions on penalty.

Reasons for Penalty:

Mr Beck admitted the breach which, is at the lower end of the scale. It is Mr Beck’s first offence under the new Guidelines and he has an excellent record. We give a $100 discount for this factor and also for his admission of the breach.
