As Mr Bayliss admitted the breach the Committee found the charge proved.

The Committee grants a deferment to Mr Bayliss’ suspension pursuant to Rule 1106(2).
Accordingly, Mr Bayliss had his license to ride in races suspended for a period to commence after racing on 17 November and conclude after racing on 25 November 2018.
Facts:
Following the running of race 3, Two Tones Catering 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Bayliss permitted his mount SHEEZANICEGIRL to shift in (near the 1300 metres) when insufficiently clear of LITE MY CIGAR which had to steady shifting back onto MEDALZA which was hampered shifting out to avoid heels hampering OHIYESA, HOUSE OF CARTIER and MELARITA.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Bayliss said that he understood the Rule and confirmed he admitted the breach.
Mr Williamson demonstrated the incident using the available video footage. He said that 100 metres after the start Mr Bayliss directed his mount in when a bare length clear of LITE MY CIGAR. He said that when Mr Bayliss crossed over to the lead he eased the pace to a degree and as a result there was a flow on effect to several horses. He said the horses named in the Information were checked to varying degrees. He added that Mr Bayliss directed his mount in too abruptly.
Mr Bayliss said he had jumped out from a wide gate and his mount “half pulled up” when it reached the lead. He admitted that he should have urged his mount further forward to avoid causing the interference.
Submissions for Penalty:
Mr Jones produced Mr Bayliss’ record which showed 2 previous breaches under this Rule in the last 12 months. He said Mr Bayliss has a good record and described the level of carelessness as just below midrange. He said a penalty should reflect that.
Mr Bayliss advised that he had commitments up to and including 17 November and sought a deferment to his proposed suspension. He asked the Committee to take into account his good record.

The Committee carefully considered all the evidence and submissions presented.
It was clear on the video films that Mr Bayliss permitted his mount to shift in shortly after the start when only 1 length clear of LITE MY CIGAR. As a consequence that runner had to be steadied and it came back on MEDALZA which was checked and as a result over raced. This caused a chain reaction to OHIYESA, HOUSE OF CARTIER and MELARITA who were all hampered to varying degrees. The Committee deemed the inward shift to be low range but the consequential effects to several runners to be in the midrange. Therefore the totality of the carelessness was low to midrange.
The JCA Penalty Guide starting point for low to midrange carelessness is 7 days which was adopted.
The mitigating factors were Mr Bayliss’ admission of the breach and his good record. For these combined factors Mr Bayliss was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
