Facts:
Following the running of Race 7, Mr Mulcay submitted an Information alleging that the horse MIKI MONTANA 'broke in excess of 50m in the final 200m'.
Mr Phelan, co-trainer of MIKI MONTANA noted on the Information that he did not wish to contest the protest, and did not wish to be present at the hearing.
Rule 869(2) states 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations (b) provide that 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Using the films Mr Mulcay identified the horse MIKI MONTANA as the field progressed up the final straight. Passing the 200m mark MIKI MONTANA went off stride and galloped to the finish. The horse finished in 5th place.
Mr Mulcay asked that the horse be disqualified from its 5th placing as it had breached the Rule and Regulations.
Reasons for Decision:
MIKI MONTANA had clearly breached the Rule and relevant Regulations by galloping further than 50m within the final 200m of the race.
