Facts:
Following the running of Race 2 (M White Racing Mobile Trot) a Protest was lodged by the Informant, alleging that BULLER WHITEBAIT (P Ferguson) broke late in the run home and was lapped on by the fifth-placed horse ROMEO FOXTROT (K Blublitz).
Judge’s Placings were:

--5th ROMEO FOXTROT
Mr Gale the Trainer of BULLER WHITEBAIT did not contest the Protest and was given approval by the Chair to be absent from the hearing.
Submissions for Decision:
Mr Mulcay showed film replays which showed that BULLER WHITEBAIT had galloped the final few strides of the event and was clearly lapped on by ROMEO FOXTROT.
Reasons for Decision:
The film evidence was crystal clear that BULLER WHITEBAIT had breached Rule 870(5) hence it was required to be placed behind the lapped on horse ROMEO FOXTROT.
