As Mr Bishop admitted the charge it was deemed to have been proved.

Penalty:

Mr Bishop is suspended from race riding from the conclusion of racing on 9th December 2013, until the conclusion of racing on 16th December 2013. That suspension encompasses meetings at Invercargill on 14th and Dunedin on 16th December 2013.

Facts:

After the running of Race 3, "The Kingfish Lodge Far North Boutique Waterfront Accommodation Maiden", Licenced Jockey RJ Bishop was charged with a breach of Rule 638(1)(d) - careless riding.

It was alleged that Mr Bishop, as the rider of "Kaapfleur" , directed his mount outwards near the 400 metres and in so doing made heavy contact with "Ellure" which was crowded on to "Double Blue" which as a result had to be steadied.

Mr McLaughlin asked Stipendiary Steward S Wallis to show the incident on the video coverage. We saw the head on, side on and rear on views of the matter complained of.

At the relevant time, Mr Bishop was racing two wide and wishing to improve. He directed his mount out sharply to at least four wide, but in so doing made contact with "Ellure" forcing that horse out on to "Double Blue". The contact was firm and the consequence was both of the affected horses lost momentum for a time whilst being steadied. To all intents and purposes, Mr Bishop simply made racing room for himself in a manner not permitted by the rules. Mr Bishop continued on and finished in 2nd place. The affected horses were unplaced.

In explanation, Mr Bishop said that his horse was having its second start at a totalisator meeting and was racing "greenly". He said he was having difficulty in controlling it. He also thought that it may have been shying away from the whip of a jockey to his inside.

Submissions for Penalty:

Mr McLaughlin said that Mr Bishop had an excellent record, and had not appeared on a charge of careless riding for at least 2 years. Mr McLaughlin said that the Stipendiary Stewards rated the degree of carelessness as being "low to medium" range. Mr Bishop had been co-operative with the Stipendiary Stewards in their enquiries and admitted his carelessness at an early stage. Mr McLaughlin submitted that a two day suspension would be the appropriate penalty.

In response, Mr Bishop said that he was not well off and asked that the suspension be as short as possible.

Reasons for Penalty:

The starting point for careless riding as set out in the Judicial Control Authority's penalty guide is a suspension of five riding days. Against that, we take into account aggravating and mitigating factors.

In this case there are no aggravating factors which warrant an uplift on our starting point.

Mr Bishop's carelessness commenced when  he effectively made room for himself and in the process making contact with "Ellure". That horse  in turn, made contact with "Double Blue", which had to be steadied. However, from that point on, a number of mitigating factors came into effect. We accept, not only from Mr Bishop's statement, but also from our own observation of the video, that the horse was racing "greenly" and kept moving out despite Mr Bishop's endeavours to straighten it. We note that it moved out again further into its run. Clearly, the horse was not an easy ride for Mr Bishop. Thus, it is this committee's assessment that Mr Bishop's degree of carelessness was low.

Mr Bishop is a South Island rider. He has an excellent record. Mr McLaughlin has submitted that a two day suspension only, should be imposed. That is an unusually lenient penalty. However, for the mitigating factors that we have referred to above, we are prepared in this case, to impose a two day suspension.
