As Mr Dell admitted the breach the charge was found proved.

Taking into account all of the above Mr Dell was fined the sum of $300.

Charge:

Following the running of Race 1, the Herrington Maiden Hurdle, an Information was lodged by Mr R Neal alleging that C Dell the rider of BEGGARS BANQUET made a celebratory gesture prior to the winning post.

Facts:

The films clearly showed Mr Dell raising his arm in the air a couple of strides short of the finishing post. Mr Dell said that it was a little confusing where the actual finishing line was as it is not properly perpendicular to the running rail. When he celebrated his win he believed himself to be at the finish line and it was only when he watched the film in the Stewards’ room that he realised his mistake.

 

Submissions for Penalty:

Mr Neal informed the committee that Mr Dell had previously been charged with the same breach in June of this year at Awapuni and on that occasion was fined the sum of $150.00. He said that Mr Dell was a very enthusiastic young man who was still learning his trade as a rider and had unfortunately misjudged his timing. He did not make any specific submissions on penalty but said that the offending was towards the lower end.

Mr Dell said that due to family connections and the death of his grandfather two years ago, this win was very memorable which led to his celebratory gesture.
 

Reasons for Penalty:

In coming to a decision on penalty the committee considered all of the submissions including Mr Dell’s admission of the breach and the submissions from the Stewards. While Mr Dell’s explanation was noted the committee reminded him that the reason for the rule was to ensure that riders continued to ride their horses out fully to the line to protect the betting public. He was also reminded of his obligation to have control of his mount at all times for safety reasons.  Whilst the breach may have been towards the low end the committee was concerned that this was Mr Dell’s second breach of Rule 638(2) in three months. This was an aggravating factor in determining penalty.
