As Mr Bosson admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Bosson had his license to ride in races suspended for a period to commence after racing on 27 October and conclude after racing on 4 November 2018.

 

Facts:

Following the running of race 1, Ssangyong, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that near the 250 metres Mr Bosson permitted his mount SHE’S NOT BAD to shift in when not sufficiently clear of TOKYO LIL which was crowded.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Bosson said he understood the Rule and confirmed that he admitted the breach.

Mr Oatham demonstrated the incident using the available video footage. He identified that passing the 300 metres Mr Rusof, the rider of TOKYO LIL, was improving to the inside of SHE’S NOT BAD. He said there was ample room for Mr Rusof until Mr Bosson permitted his mount to shift in one and a half horse widths. He said the incident was further exacerbated when there was a shift from horses racing to the inside of Mr Bosson’s mount. He added that the shift from the inside horses contributed to the crowding.

Mr Bosson said that he permitted his mount to roll in and added he was racing in tight quarters. He said that Mr Waddell was attempting a tight run near the inside and this manoeuvre contributed to the interference.

Submissions for Penalty:

Mr Coles produced Mr Bosson’s record which showed 1 previous breach under this Rule in the last 12 months. He said that Mr Bosson has been off the scene for a while and advised that Mr Bosson has had 192 rides in the last 12 months. He described the level of carelessness as low range and a suspension in line with that would be appropriate.

Mr Bosson said that he had commitments up to and including 27 October and any proposed suspension could start after that date.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

It was clear of the video films that Mr Bosson permitted his mount to shift in at least one horse width when not sufficiently clear of TOKYO LIL. As a consequence that runner was crowded and checked. The Committee accepts that there was a shift from the inside horses when Mr Waddell was pushing his mount into a narrow gap which contributed to the interference. The Committee deemed the totality of the carelessness as low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.

There were no aggravating factors.

The mitigating factors were Mr Bosson’s admission of the breach and his good record for which he was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
