ID: JCA13696
Code:
Thoroughbred
Meet Title:
Racing Tauranga - 13 November 2010
Meet Chair:
RSeabrook
Meet Committee Member 1:
BTims
Race Date:
2010/11/13
Race Number:
R 1
Decision:
As the breach was admitted we find the charge proven.
Penalty:
After taking all the above factors into account we impose a suspension on Miss Collett from riding in races which is to start after racing on 20 November and conclude after racing on 26 November 2010 (4 riding days)
Charge:
Following race 1 an Information was filed pursuant to rule 638 (1) (d). The informant Mr Oatham alleged that Miss Collett permitted her mount MISS BLING to shift inwards shortly after the start when not sufficiently clear of CHIVAS REGAL (P Holmes). Thi
Facts:
Mr Robinson demonstrated the video films and pointed out to the committee MISS BLING (S Collett) begin to move in immediately after the start from its midfield draw. Miss Collett continued to allow her mount to move in for some strides without taking corrective action. Mr Robinson said Miss Collett did not do enough to straighten her mount with the result being a sharp check to CHIVAS REGAL which eventually finished second.
Submissions for Decision:
Miss Collett admitted the breach and had nothing to say.
Reasons for Decision:
.
Submissions for Penalty:
Mr Oatham said Miss Collett had an excellent record with only one charge in the last 12 months. However his concern in this case was that Miss Collett had continued to ride in causing CHIVAS REGAL to race further back in the field than it normally prefers to. However Mr Oatham submitted that Miss Collett’s carelessness was at the low end.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are Miss Collett’s admission of the breach and her outstanding record. However these must be balanced against the interference received by CHIVAS REGAL. Miss Collett was not the required distance clear when moving in and she did little to correct her mount. The committee explained to Miss Collett that this charge would normally warrant a 5 day suspension. However considering the mitigating factors above we have reduced this to one of 4 days.
