The protest is upheld and THUNDER BUDDY is disqualified from fourth placing.

The official placings are now:

1st: Pickett’s Ridge (8)

2nd: King Cassidy (14)

3rd: Rydgemont Milly (13)

4th Cascadia (9)

All placings are duly authorised.

Facts:

Following the running of race 5 the Invercargill Workouts Committee Mobile Trot Stewards lodged a protest information under r 870 (3) alleging that THUNDER BUDDY (AR Beck) “…broke from its gait in excess of 50 metres in the home straight.”

Rule 870 (3) reads:

Any horse which breaks from its gait shall retain its proper gait.

The Breaking Horse Regulation provides as follows:

(b) Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of 50m or greater, shall be deemed to be in breach of r 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall:

(ii) disqualify it from the race under r 1003 (2)

The official placings were:

1st: Pickett’s Ridge (8)

2nd: King Cassidy (14)

3rd: Rydgemont Milly (13)

4th Thunder Buddy (12)

5th Cascadia (9)

The connections of Thunder Buddy did not contest the protest.

Mr Munro, with the aid of the videos, said THUNDER BUDDY was improving wide out in the home straight. Inside the 100 metre mark THUNDER BUDDY trotted roughly for several strides and then broke from its gait. It continued in a break until the finish line.

Mr Renault stated THUNDER BUDDY refused to settle and was not in its proper gait in excess of 50m, and was in breach of the rule.

Reasons for Decision:

The committee is satisfied that THUNDER BUDDY broke free of interference and was not in its proper gait in excess of 50m in the home straight.
