Alleged breach of Rule 619

Facts:

Following the running of Race 4 Information A4077 was filed with the Judicial Committee under Rule 619. The Information stated that Apprentice Jockey Mr Turner changed his gear after weighing out (riding boots). Mr Turner and Mr McQuade said that they understood the rule and the charge. The information was signed stating that the breach was admitted.

Submissions for Decision:

Mr Goodwin said that Mr Turner changed his boots after weighing out to ride Mr Mendelssohn in Race 4.

Mr Turner said that he weighed out in old patched boots and then after Race 3 he changed into Dylan Turner’s good boots to ride in Race 4. He said he was going to weigh out in Dylan’s boots but because Dylan had a ride in Race 3 and that he had to weigh out early he did so in his old boots. He said that the Stewards weighed both sets of boots and that they weighed exactly the same and that he did not do it for a weight advantage. He said that he was not cheating and that he only changed boots because his were old and patchy. Mr McQuade said that Mr Turner had made a mistake but that he was partially responsible as he wanted Mr Turner to weigh out early so that he could get down to the stable and saddle up in good time without rushing to do things.

Submissions for Penalty:

Mr Goodwin said that Mr Turner had not been charged with changing boots before today and that the Stewards accepted Mr Turner’s explanation and submitted that an appropriate fine would be $200.00. Mr Turner and Mr McQuade made no comment re penalty.

Reasons for Penalty:

The committee took into account Mr Turner’s good record, other penalties imposed for similar offences, the JCA starting point and determined that a fine of $200 was a suitable penalty.
