As Mr Hutchings admitted the breach we find the charge proved.
Penalty:
We grant Mr Hutchings' request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Mr Hutchings which will commence after racing on 15th December 2012 and conclude after racing on 21st December 2012 (5 days).
Charge:
Following race 8, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Oatham alleged that passing the 1100 metres Mr Hutchings permitted his mount MAE JINX to shift in when not sufficiently clear, forcing DURHAM TOWN into the line of DEMOPHON (C Dell) which was checked hampering TRAPICHE (M Sweeney) and COOL STORM (A Calder).
Prior to the hearing commencing Mr Oatham informed the committee that Mr Hutchings had sought permission from his employer Mr Rogerson to represent himself at the hearing. Mr Hutchings confirmed to the committee that he had gained permission to do so.
Facts:
Mr Williamson demonstrated the incident by using all the available video films. He pointed out to the committee on the head on film that Mr Hutchings had drawn the outside barrier and ridden his mount forward. In doing so he was only ½ a length clear when taking the rightful running line of DURHAM TOWN who was directly on his inside. This movement resulted in crowding to 3 horses on their inside.
Mr Hutchings told the committee that he was instructed to go forward at all costs. He said he gave his mount a hit behind the saddle shortly after the start to go forward and believed his mount reacted by ducking in briefly. He said he tried to straighten MAE JINX prior to the point of the first corner but conceded there was a lot of trouble on his inside.

Mr Oatham produced Mr Hutchings record which showed 4 previous breaches under this rule in the last 12 months. He said Mr Hutchings was a busy rider with a relatively good record. He submitted the aggravating facts were the race was of Group 3 status and the level of carelessness was mid range.
Mr Hutchings submitted that he had firm commitments up to and including 15th December. He submitted that he rode all over the country and requested a deferment to his proposed suspension.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Hutchings' admission of the breach and his overall good record for a busy rider. The aggravating facts are the level of carelessness which we independently assess as mid range, we note that 4 runners were hampered, the status of the race a Group 3 worth $70,000. Balancing all of the above facts we assess an appropriate penalty is 5 days. We acknowledge that Mr Hutchings does genuinely ride all over the country therefore all race dates were included in his penalty.
