"Galleons Legend" is disqualified from its second placing pursuant to Rule 1003(2).

The amended placings are therefore:

  5. "Phoebe Revival"  (12)

Facts:

In Race 4 "Galleons Legend" broke from it's trotting gait approximately 200 metres from the winning post and galloped for the remainder of the race. The driver of "Galleons Legend", Mr M Hay, said that despite his best efforts, he could not get the horse to return to a trot.

"Galleons Legend" crossed the line in second place. The Judge's official placings were:

  1. "JD Spur"  (6)
  2. "Galleons Legend"  (3)
  3. "Paint the Moon"  (8)
  4. "Patch Bromac"  (10)
  5. "Sun of Mystery"  (4)
  6. "Phoebe Revival"  (12)

Submissions for Decision:

Mr Ydgren submitted that as the horse had galloped continuously, for the last 200 metres of the race that not only was it in breach of Rule 870(3) it was also in clear breach of the Breaking Horses Regulations, and should be disqualified.

Reasons for Decision:

Mr Hay, the driver of "Galleons Legend" did not contest the protest.

The evidence was clear. "Galleons Legend" galloped over the last 200 metres in breach of Rule 870(3) and in breach of the Breaking Horses Regulations.
