As Mr Asano admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Asano’s license is suspended from the close of racing on Sunday October 13th up to and including racing on Sunday October 20th 2019.

Facts:

Following the running of Race 2 (Rough Habits/Hub Catering 1600), an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that K Asano permitted his mount “ROCK ISLAND LINE” to shift outwards when not sufficiently clear of RIPCORD which had to be restrained over the final 50 metres.

Mr Asano, who is apprenticed to Mr A Carston and was assisted by Ms Clapperton, confirmed his understanding of the charge and his admission of the breach.

Mr Oatham played the films and showed where Mr Asano moved outwards under a hard ride into the line of Ms Myers' mount RIPCORD. When he first moved outwards he was borderline clear of RIPCORD however Ms Myers improved forward, and Mr Asano continued his shift outwards. Ms Myers was left with nowhere to improve and, as a result, was disadvantaged over the final stages.

Ms Clapperton said that before the incident, the horse just in front of Mr Asano moved outwards a little and he followed it across.

Mr Asano said his horse had been hanging inwards and he tried to correct it by pulling on the right rein but had over-corrected.

Submissions for Penalty:

Mr Goodwin said this was Mr Asano’s first charge of careless riding. He has been riding for 2 years and has had 197 race day rides. The Stewards classed today's breach as in the low-midrange and submitted that a suspension was appropriate.

Ms Clapperton asked that Mr Asano’s good record be taken into account. Mr Asano advised of riding commitments through until Sunday October 13th.

Reasons for Penalty:

The Committee considered all submissions. Mr Asano has an excellent record, and it is to his credit that this is his first careless riding charge in 2 years of riding. While he allowed his mount to shift outwards we accept that it was as a result of him trying to correct the horse’s tendency to hang. He erred in not taking corrective action earlier and was careless in not doing so. We placed the incident in the low range. The Committee adopted a starting point of 6 days suspension and gave credit for Mr Asano’s clear record and admission of the breach.

Balancing up all factors it was our opinion that a 5-day suspension was an appropriate penalty.
