Facts:
Following the running of Non Tote Race No 2 an Information Instigating a Protest was lodged by Stipendiary Steward Mr TW Taumanu against the second placing of horse No 1 You Rock on the grounds of breaking shortly after the start and continuing in a break for in excess of 150 metres. Mr RW Green, Trainer of You Rock was present and advised this Committee that he did not contest the protest and endorsed the Information.
Rule 870(3) provides:
“Any horse which breaks from its gait shall promptly regain its proper gait”
The Breaking Horse Regulations Part A provides:
“Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait”
Submissions for Decision:
Mr Taumanu demonstrated the incident by use of the video films. The films showed quite clearly You Rock breaking approximately 150 metres after the start and despite the efforts of its Driver Mr MW McKendry it continued on in the break for approximately 200 metres.
Reasons for Decision:
The protest is not contested and clearly the provisions of Rule 870(3) and the Breaking Horse Regulations apply.
