Facts:
Following the running of Race 2 an Information instigating a protest was filed by Stipendiary Steward, Mr P Williams, against THE MIGHTY MONDO (G Smith), placed 4th by the judge, on the grounds that it “galloped in excess of 150 metres over the early stages”.
Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.
Relevant clauses from the Breaking Horse Regulations state: (a)
Any horse which breaks from its gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater shall be in breach of Rule 870 (3) in that it has failed to properly regain its proper gait.
Mr Williams with the assistance of Mr Renault, showed the Race video and identified THE MIGHTY MONDO drawn 5 at the 2600 stand start barrier. He pointed to THE MIGHTY MONDO who paces for one stride and then breaks from its gait, free of interference. Mr Williams contended THE MIGHTY MONDO has continued on in a gallop for approximately 300 metres.
Mr Williams sought disqualification of THE MIGHTY MONDO.

Reasons for Decision:
The Committee was satisfied that THE MIGHTY MONDO had broken from its gait, free of interference, for approximately 300 metres from the start of the Race, placed 4th by the Judge, and therefore in breach of Rule 870(3) and the Breaking Horse Regulation.
