Decision:

We find the charge proved.

Penalty:

The result is a suspension of 3 days. Mr Johnson is currently suspended from 2 January 2012 up to and including 6 January. He is further suspended from 7 January up to and including 12 January 2012. This is 3 days.

Charge:

Mr Ray, stipendiary steward, alleged that Mr Johnson allowed his mount BREMUSA to shift in passing the 75 metres crowding the running of CINNAMON (L Allpress), APATCHEE TUTE (A Mundy) and ELIGIBLY (T Direen), who all had to steady.

Facts:

Mr Ray had Mr Davidson demonstrate on the videos that shortly after the 100 metre mark, when Mr Johnson was riding BREMUSA with the whip, that horse shifts inwards and crowds the horses on its inner, with the riders of those horses having to take corrective action.

Submissions for Decision:

Mr Ray accepted BREMUSA was racing greenly and that at one point the defendant had the horse’s head turned out in an attempt to relieve the pressure but in his opinion these efforts were not enough. He said the defendant was not making a sufficient effort to keep the horse straight and was continuing to ride the horse out with the whip.

Mrs Allpress, the rider of CINNAMON, said she was racing on the inner of BREMUSA when that horse commenced to roll in. She said the jockeys on her inner were yelling for room. She said she had not had the opportunity to call out herself. She was unable to relieve the pressure her horse was under. This pressure came from the defendant riding on her outside. She confirmed her horse was not moving out nor were the horses on her inner.

Mr Johnson asked us to consider BREMUSA was a lightly raced horse that was racing greenly. He said it was inclined to run away from the horse that had come up on its outside. He said BREMUSA was shying and moving in. He said he had given a couple of yanks on the outside rein and that the horse was racing in a shadow roll. When questioned by this committee was to why he continued to use the whip, he said he did not realise at the time that he had shifted in as much as he had. We also asked Mr Johnson to demonstrate the 2 yanks. He pointed out one time when BREMUSA’s head could be seen to turn outwards.

Reasons for Decision:

We accept, as does the informant, that BREMUSA was racing greenly. It was giving the defendant a hard ride. The horse was moving in and away from the horse going past on its outside. BREMUSA is clearly rolling in and we accept that Mr Johnson has made one attempt to turn the horse’s head and keep it off the horses on his inside. Unfortunately he continued to punch the horse out to the line while using the whip in the left hand. The consequence was that BREMUSA continued to shift inwards and took the running line of Mrs Allpress, with crowding to a number of runners and their being checked. The defendant says he did not realise he was moving in as much as he was. The stewards accept the defendant made an effort to straighten the horse but unfortunately he continued to use the whip pushing BREMUSA forward. The defendant’s continuing to push BREMUSA forward while that horse was rolling in and whilst still using the whip in our view constitutes careless riding.

Submissions for Penalty:

Mr Ray produced Mr Johnson’s record. This showed 3 recent suspensions, including one on Boxing Day at Wingatui. He said the breach was at the lower end of careless riding and submitted a suspension of 3 to 4 days was appropriate.

Mr Johnson did not wish to comment.

Reasons for Penalty:

We agree the breach is low range. BREMUSA was clearly rolling in and giving the defendant a difficult ride. Because of the horse’s manners we take a starting point of 4 days and after give credit for the defendant’s record, which is still very good despite the recent breaches, when consideration is given to the number of rides he has had this season.
