As the Charge was admitted it was deemed to be proved.

Penalty:

Mr Pinn’s Apprentice Jockey’s Licence was suspended from the close of racing on 19 January through to the end of racing on 28 January 2019.

(Te Rapa 20 January was not included as riders had been declared).

Facts:

Following the running of Race 5 (Peninsula Beachfront Resort Mooloolaba Supporting Life Education Trust 1400) Information No. A12270 was filed with the Judicial Committee. It was alleged that Mr Pinn had allowed his mount MALO BIK to shift outwards inside the final 100m when not sufficiently clear causing interference to MIKJENE.

Mr Pinn had the Rule read following which he confirmed that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Oatham showed all film replays and said that Mr Pinn drew the whip and that his horse shifted out when being ridden along with the whip. He said that he hit the horse approximately 6 times when shifting. He added that in his opinion the interference that occurred was minimal.

Mr Sharrock on behalf of Mr Pinn said that MALO BIK is a rogue of a horse that has a tendency to lay out and that Mr Pinn used the whip to stop him moving out. He added that in a prior race a senior rider had difficulty controlling the horse.

Mr Harris said that he supported Mr Sharrock’s comments. He added that there was only one movement and that it was minimal and that Mr Pinn was doing his best to keep his horse straight.

Submissions for Penalty:

Mr Goodwin said that he did not agree with Mr Harris’ final comment and said that Mr Pinn should have put the whip away. He said that although the interference was minimal it was sufficient for a Protest to be upheld. He placed the degree of carelessness in the low to mid-range.

Mr Pinn’s record showed the following suspensions imposed during the last 12 months for careless riding:

9 August 2018--5 days suspension
-8 September 2018-7 days suspension
-8 December 2018-8 days suspension
-29 December 2018-9 days suspension

Mr Sharrock said that Mr Pinn had rides on 19 January only and that a suspension could start after that date.

Reasons for Penalty:

The Committee independently placed the careless riding by Mr Pinn in the low-range category. Having regard for his record and the JCA Penalty Guidelines it was determined that a suspension of 6 riding-days was a suitable penalty.
