Charge:
Following race 10 an information was filed pursuant to Rule 869(3)(b).The informant Mr Muirhead alleged that Ms Chilcott drove DIAMOND SMILE carelessly in that she allowed her horse to shift inwards while under a drive causing HARRY THE MAORI to be tightened for room.
Facts:
Mr Muirhead demonstrated the incident using the head on and side on films. He pointed out to the committee that DIAMOND SMILE does shift ground inward over the concluding stages. He highlighted that inside the final 20 metres Mr Butt the driver of HARRY THE MAORI when racing in a 3rd position was forced to take a hold of his horse due to the inward movement from Ms Chilcott.
Mr Butt told the committee that he accepted the evidence put forward by Mr Muirhead to be correct believing his horse would have run 3rd if it had not been interfered with.
Ms Chilcott in admitting the breach acknowledged the evidence presented at the protest hearing could be accepted for this careless driving charge. Ms Chilcott did concede that she moved in over the concluding stages affecting the chances of HARRY THE MAORI.
Submissions for Penalty:
Mr Muirhead produced Ms Chilcott's record which showed no previous breaches of this rule in the last 12 months. He submitted the JCA Penalty Guide provided for a starting point which caused a relegation was 10 drives or a $500 fine.
Ms Chilcott submitted she would prefer a fine rather than a suspension as she has a lot of driving commitments.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Ms Chilcott's admission of the breach and her excellent driving record. However this has to be balanced against the fact her carelessness although only occurring for 20 to 30 metres the outcome resulted in DIAMOND SMILE being relegated from 1st to 4th place.
