Facts:
Following the running of Race 1, Bishopdale/Bush Inn TAB’s & Tavern Harewood Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Advanced Amateur Driver, Mrs M Hallett, alleging that, as the driver of BILLY JACK in the race, she drove carelessly in that “in the early stages of the race [she] shifted inwards and made contact with the sulky wheel of FRANCO CALIPH”.
Mrs Hallett was present at the hearing of the information and she indicated that she admitted the breach.
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly
Mr Renault showed video replays of the incident, shortly after the start of the mobile 1950 metres race. He pointed out BILLY JACK, driven by Mrs Hallett, which had drawn barrier position 7 on the front row, and FRANCO CALIPH (R J Sissons), which had drawn 6. He then pointed out BILLY JACK pace roughly shortly after the start and, approximately 150 metres after the start, Mrs Hallett angled her horse’s head inwards and, as the horse shifted inwards, its off-front leg contacted the sulky wheel of FRANCO CALIPH, resulting in BILLY JACK going off stride and losing ground. Mr Renault said that Mrs Hallett could be seen to direct her horse’s head inwards when not sufficiently clear of FRANCO CALIPH.
Mrs Hallett said that, initially, she thought that her horse had lugged in but, on viewing the replay she accepted that she had directed it in. She accepted that she had made an error of judgement.
Submissions for Penalty:
Mr Renault told the Committee that Mrs Hallett was in her second season as an Amateur Driver. She had nine drives last season and, before this drive, two in the current season. This was the first occasion on which she had been charged for any breach. Mr Renault submitted that, having regard to Mrs Hallett’s admission of the breach and her good record, a fine in the vicinity of $300 was appropriate.
Mrs Hallett had no submissions to make in relation to penalty.
Reasons for Penalty:
In determining penalty, the Committee had regard to the starting point for penalty as provided in the Penalty Guide – a $500 fine. Mrs Hallett was entitled to a discount for her admission of the breach and her previously unblemished record. We fixed that discount at $200. There were no aggravating factors.
