As Ms Wigg has admitted the breach, we find the breach proved.

Ms Wigg is fined the sum of $200.

Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Ms Wigg exceeded the permitted number of strikes when driving ALEXY inside the final 400 metres of race 1, the SUPREME EQUINE FEED ASHBURTON/ALEXANDRA NEW WORLD MOBILE PACE.

The Use of the Whip Regulations made pursuant to r 869(2) and effective 30 November 2017 provides:
No horsewoman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Tidmarsh demonstrated on the videos that the respondent used her whip at least 13 times in the last 400 metres.

Ms Wigg has signed the information stating she admits the breach and does not wish to be present. She told the Stewards she was positioned far back in the sulky and this was the reason for her using the whip.

Submissions for Penalty:

Mr Tidmarsh tells us Ms Wigg has accepted that 13 is the number of strikes. We agree.

Reasons for Penalty:

This is Ms Wigg’s first breach of this rule since the regulations came into force on 30 November 2017.

The penalty is determined by a sliding scale. Where the number of strikes is between 11 and 13, and it is a first offence, it is $200. The count for Ms Wigg is 13.
