The protest is dismissed.

The placings are as the horses crossed the line. Stakes and dividends are to be paid accordingly.

Facts:

Mr Bothamley alleged that MINUTES TO MIDNITE, which was placed first by the Judge, interfered with the chances of his horse, MAC MURDOCH, which was placed second, the interference occurring over the concluding stages.

Judges placings were:

1st  MINUTES TO MIDNITE
2nd MAC MURDOCH
3rd CONCEAL
4th ODI ET AMO

Submissions for Decision:

Mr Bothamley demonstrated on the videos that MINUTES TO MIDNITE shifted wider on the track in the run to the line. He froze the video at a point he described as some 3 or 4 strides from the line where he believed contact had been made by MINUTES TO MIDNITE with his horse. He emphasised the winning margin was a nose and that he had been placed in restricted room. He agreed with the Committee that he had not had to stop riding MAC MURDOCH.

Ms Dalton said she supported Mr Bothamley’s comments and had nothing further to add.

Mr Chan acknowledged that he did shift out but denied there was contact. He said MAC MURDOCH had not lost momentum and that Mr Bothamley had the whip in his right hand and thus had been able to use it.

Mr Harnett stated that he believed the video was clear and there was no interference. MAC MURDOCH had not lost momentum and there had been no contact. He did not believe MAC MURDOCH had changed stride and the finish had come down to the bob of the head.

Mr Bothamley replied there had obviously been contact as the video demonstrated MAC MURDOCH had stepped out for a stride.

Mr Davidson said it was a close finish and there had been some movement from MINUTES TO MIDNITE. He believed any contact was right in the shadow of the post, perhaps half a stride from the line.

Reasons for Decision:

The Committee is satisfied the horses do touch, but there is no significant contact between the two. The contact is at best a stride or a stride and a half from the line and there is no impediment to Mr Bothamley riding his horse out. He is able to use his whip and there is no discernible loss of momentum by MAC MURDOCH.

In these circumstances the Committee is not satisfied that MAC MURDOCH would have beaten MINUTES TO MIDNITE had the horses not lightly touched in the shadows of the post and the protest is dismissed.
