On returning to the enquiry room the parties were advised that a full written decision would be available on the JCA website as soon as possible. They were told the protest was dismissed and the placings as called by the Judge (as detailed above) were confirmed. The authorisation to pay all dividends was given.

Facts:

Following the running of race 3, information 31093 was filed by Licensed Jockey Mr M Cameron under rule 642 (1). The information stated that “I, M Cameron, allege that “Van Helsing” or its rider placed first by the judge interfered with the chances of “King Leonidas” placed third by the judge. The interference occurred in the final straight”.

Rule 642 (1) states:-
“If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”

The official placings in the race were:-
1st - 9 Van Helsing
2nd - 5 Logan James
3rd - 8 King Leonidas
4th - 7 Szyslak
5th - 2 Nautidan
6th - 11 Repenting

The official margin between 1st and 2nd was ¾ length and between 2nd and 3rd was 1 length.

Submissions for Decision:

Mr Cameron used the head on view of the film to show that on entering the home straight he was racing four out from the rails and behind “Van Helsing” and “Logan James”. He said his horse was not going good enough at that point of the race to take a gap between those two horses but near the 200m mark he started to get going at the same time as Mr Kasim started to drift inwards and close the gap he was trying to take. He said near the 100m mark he received a severe check, losing momentum, which forced him to come out from behind Mr Kasim. He then finished the race off well ending up a length of the winner.

At the request of the Committee the side on film and a view taken from the 800m tower were shown. To a question from the Committee Mr Cameron said that he felt he lost approximately1½ to 1¾ lengths in the incident and then made up around ¾ length in the run to the finish.
Mr Kasim said that as “Van Helsing” and “Logan James” progressed down the straight it was “Logan James” that moved inwards that caused the gap that Mr Cameron was trying to take to close. He agreed he had also moved in slightly but felt the inwards movement of Logan James” was the main reason Mr Cameron could not take the gap.

Mr Sharrock asked for confirmation of the margins between first and third. He said that the interference was minimal, occurred over only 2 strides and that after it occurred “King Leonidas” made no ground on the winner in the run to the finish line and he felt that the winner was actually pulling away at the end of the race.

Stipendiary Steward Mr R Neal said early in the home straight a marginal run did present itself for Mr Cameron to improve into but his horse was unable to take the gap at the time. Further down the straight he said there was an even smaller gap between “Van Helsing” and “Logan James” which Mr Cameron persisted in trying to take and was unable to do so. He said that once Mr Cameron steadied his mount and pulled out from behind “Van Helsing” he did not make any ground on the winner and given the margin between the winner and the 3rd horse was 1¾ lengths the stewards did not support the protest.

Reasons for Decision:

The Committee has reviewed the films of the incident and listened carefully to the submissions of all parties. At the top of the straight Mr Cameron was racing behind “Van Helsing” and “Logan James” but by his own admission not going well enough to take the gap that was available to him. As all three horses continued to race down the straight the gap available for Mr Cameron to take narrowed due the to the slight outwards movement of “Logan James” and the slight inwards movement of “Van Helsing”. Mr Cameron persisted in trying to take the gap until at approximately the 100m mark he then elected to move out from behind “Van Helsing. Whilst the film does show Mr Cameron steadying his mount near the 100m mark the Committee does not believe he received what he described as a “severe check”. Whilst Mr Cameron did lose some momentum in having to pull out from behind “Van Helsing”, in the run to the finish line from the 100m mark he clearly did not make up any ground on “Van Helsing”.

The gap between the winner and the third horse was 1¾ lengths. We do not believe that, had the incident described by Mr Cameron not occurred, he would have finished ahead of the winner of the race and accordingly the protest is dismissed.
