Facts:
Following the running of Race 2, McKnight and Brown Maiden, an Information was lodged by Stipendiary Steward, Mr M Davidson against Class A Rider, Mr D Bothamley alleging careless riding in that he permitted his mount SOVIET WONDER to shift inwards when not sufficiently clear of LILY OF THE VALLEY, which was forced inwards crowding DARCI VINO which was checked near the 1100m.
Rule 638(1)(d) reads as follows:
1.-A rider shall not ride a horse in which the judicial committee considers to be.
d. -Careless.
Mr Bothamley has indicated on the Information A11773 that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Bothamley also agreed that he understood the charge and the Rule it was brought under.
Mr Oatham (Chief Stipendiary Steward) gave evidence, and used the video coverage to highlight, SOVIET WONDER shifting inwards when only three quarters of a length clear of LILY OF THE VALLEY (M Gestain) which was forced inwards, and crowding DARCI VINO (K Kwo), which was checked.
Mr Bothamley had no issue regarding Mr Oatham’s summation of the events.
Submissions for Penalty:
Mr Davidson stated that Mr Bothamley had a very good record with no breaches under this rule over the past 12 months.
Mr Davidson believed the breach was mid to low end of carelessness. Mr Davidson confirmed Mr Bothamley has had 150 rides this season.
Mr Davidson believed, a penalty suspension between 3 to 4 riding days and a fine at the lower end of the scale would be appropriate, ranging from $250 to $400 as the JCA Guide outlines.
Mr Bothamley requested a deferment of penalty with no further submissions.

The Committee placed the carelessness at the lower end of the range with the JCA Penalty Guide starting point being a four-day suspension and a $250 fine.
Mr Bothamley was given credit for his outstanding riding record over the past 12 months and his early admittance of the breach and as a result a one riding day reduction was applied.
Mr Bothamley was granted deferment of penalty.
