As Mr Johnson admitted the breach of careless riding it was found to be proved.

Penalty:

After hearing from Mr Johnson regarding his forthcoming riding intentions, his Jockey’s Licence was suspended from the cessation of racing on 7 May 2016 up to and including racing on 15 May 2016 (4 days).

The 4 days being:
12 May - Otaki
13 May - Ashburton
14 May - Taranaki/Rotorua (Premier)
15 May - Wairio

Facts:

Subsequent to the running of Race 1, (HAWKES BAY OWNERS & BREEDERS ASSOCIATION MILE) Information No. A7660 was filed with the Judicial Committee. It was alleged that Mr Johnson, the rider of BRIAR ROSE, allowed his mount to shift in going into the first bend and caused a check to CASTING CALL (L Satherley).

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Johnson said that he understood the charge, the Rule and confirmed to the committee that he admitted the breach of the Rule.

Mr Goodwin identified on the films the horses in the barrier stalls prior to the start, showing where Mr Johnson and his mount were positioned in the outside barrier stall with CASTING CALL positioned a little further in. Mr Goodwin then said that shortly after the start at the 1600m, Mr Johnson angled his mount across in an attempt to get closer to the running rail and at that point he was not clear of Ms L Satherley, who had to take a hold of her mount and check off Mr Johnson’s horse’s heels. He added that Ms Satherley had to steady for a good 3 to 4 strides. He added that ROC ‘N’ IT (D Bradley) who was racing inside of CASTING CALL at the time, did receive some minor tightening also. He said that Mr Bradley had said that his horse had contributed by over-racing.

Mr Johnson in response said that he may have made it a bit tight, that his horse had only had a couple of starts, that CASTING CALL was having its first start which might not have helped things and that his horse took the corner too well.

Submissions for Penalty:

Mr Goodwin said that during the past 12 months Mr Johnson had a very good record in that he had only incurred two suspensions for careless riding. Those being at Canterbury on 7 November 2015 (4 days) and Canterbury on 5 August 2015 (4 days). He placed the degree of carelessness below mid-range and said that in Mr Johnson’s defence, Ms Satherley did say to the Stipendiary Stewards that her mount was racing greenly at the time. He submitted that a term of suspension be imposed.

Mr Johnson said that he would like to take the 7 day deferment to allow him to ride at Canterbury on 7 May 2016.

Reasons for Penalty:

The committee in determining quantum of penalty took into account the admittance of the breach, Mr Johnson’s good record, the severity of the interference, the starting point for careless riding and the degree of carelessness. It was the committee’s opinion that the carelessness exhibited by Mr Johnson was in mid-range. The films clearly showed that when Mr Johnson and his mount shifted in across the rightful running line of CASTING CALL, that Ms Satherley was placed in a very awkward position, which took her several strides to clear and avoid the heels of Mr Johnson’s mount. At no stage did Mr Johnson appear to take any corrective action to relieve the pressure.
