Mr Beeharry having admitted the breach, the charge is found proved.

Penalty:

Mr Beeharry’s Apprentice Jockey’s Licence (Class B) is suspended for a period from after the conclusion of racing today, up to and including 28 March 2020 – 9 national riding days.

Facts:

Following the running of Race 8, Ecolab R82, an Information was filed by Stipendiary Steward, Mr DM Wadley, against Licensed Apprentice Jockey (Class B), Mr R Beeharry, alleging that Mr Beeharry, as the rider of TICKET TO RIDE in the race, “permitted his mount to shift inwards when not sufficiently clear of SHARP ‘N’ SILVER (K Asano) which was dictated inwards crowding HE’S GOLD (Y Chew) which was severely checked approaching the 1000 metres”.

Mr Beeharry had signed the Statement by the Respondent on the Information form indicating that he admitted the breach and he confirmed this at the hearing of the information at which he was present. He was assisted at the hearing by Apprentice Jockey Mentor, Mr DM Walsh.

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
    (d) careless.

Mr Wadley had Chief Stipendiary Steward, Mr JP Oatham, show head-on and side-on video replays of the incident, approximately 600 metres after the start of the 1600 metres race. He pointed out the relevant runners – TICKET TO RIDE ridden by Mr Beeharry, which had drawn barrier 8 in the 10-horse field, SHARP ‘N’ SILVER, which had drawn immediately inside it in barrier 7, and HE’S GOLD, which had drawn barrier 4.

Mr Oatham said that Mr Beeharry had crossed from out wide to a 3-wide position with Mr Asano inside him and HE’S GOLD on the inside of those two runners. Mr Beeharry then shifted in and dictated Mr Asano’s mount inwards which caused a check to HE’S GOLD. In Mr Beeharry’s defence, he may have anticipated that Mr Asano was going to shift to the rail at that point, Mr Oatham said.

Using the side-on video replay, Mr Oatham showed that Mr Asano had almost crossed to the rail but Mr Chew had improved his mount well up into and was established in the gap to the inside of Mr Asano’s mount. That was when Mr Beeharry asked his mount to shift in which caused a check to Mr Asano and then to Mr Chew. Mr Oatham added that a more experienced rider than Mr Chew may not have put his mount in that position but, once he did, he became entitled to that run. When he was checked, he came back and clipped heels with Mr Asano’s mount and went back on MONRECOUR (K Williams) and QUINTUPLE TWINS (C W Johnson).

In response to a question from the Committee, Mr Oatham said that, at the point where he shifted in, he estimated that Mr Beeharry would have been no more than a bare length clear.

Mr Walsh said that HE’S GOLD had got into a tight spot prior to the incident and he agreed with Mr Oatham that a more experienced rider may not have gone in there, but Mr Chew was in there and he was established. There had not been a problem until TICKET TO RIDE moved in. Mr Walsh said that Mr Beeharry had made an error of judgement.

Mr Beeharry said that he had been attempting to hold his mount, which was carrying 61 kilograms but SHARP ‘N’ SILVER had gone in front of him and he was trying to let that runner go. His own mount had kept shifting in and he had not anticipated that Mr Asano would have another runner inside him.

The Committee observed, and Mr Walsh agreed, that Mr Beeharry had looked to his inside on a couple of occasions.

Submissions for Penalty:

Mr Wadley told the Committee that Mr Beeharry has one previous charge of careless riding in the last 12 months – at Otago on 23 August 2019. Stewards saw the present breach as being high-end, but there was a mitigating factor of Mr Chew having taken the gap inside Mr Asano.

Mr Beeharry has had 128 rides this season, Mr Walsh said, which was a good record.

In the last 12 months, Mr Oatham said, Mr Beeharry has had 196 rides.

Mr Walsh submitted that Mr Beeharry does not get many “nice” horses to ride. TICKET TO RIDE would have been one of his nicer rides, he said. He also referred to the mitigating factor. The amount of movement was not great, Mr Walsh submitted, but the consequences were quite serious. The breach was mid-to-high, Mr Walsh submitted.

Reasons for Penalty:

The Committee considered the degree of carelessness to be in the high range in this case and, on that basis, took a starting point for penalty of a 10 national riding days suspension. But for Mr Chew’s minimal contribution to the incident, we may have taken a higher starting point. The Committee accepted that Mr Beeharry’s record was a good one and he had admitted the breach. A combination of those factors warranted a discount of one day.
