Facts:

Following the running of Race 1, the Supreme Equine Feeds Mobile Pace, an Information was filed by Chief Stipendiary Steward, Mr N Ydgren, against Amateur Driver, Mr B Wilmott, alleging that “Mr Wilmott (IT’S A DEAL) drove carelessly near the 300 metres when allowing his horse to contact the sulky wheel of JOEY MAGUIRE resulting in the tyre being punctured.”

Mr Ydgren confirmed Mr Wilmott had admitted the breach and that he did not want to be present at the hearing.

Rule 869 provides as follows:
(2) No horseman in any race shall drive: -
(b) carelessly

Mr Ydgren with the assistance of Mr Renault used the race films to identify Mr Wilmott driving IT’S A DEAL in the trailing position approaching the 300 metres. Shortly afterwards they pointed to Mr Wilmott moving out from behind the leader JOEY MAGUIRE and striking the outside wheel and blundering for a stride before continuing on to run second.

Mr Ydgren said the Stewards were of the opinion that Mr Wilmott, who was “travelling”, had waited too long to pull his horse out and as a consequence got too close to the lead horse.
Mr Ydgren said Mr P Wallace, the driver of JOEY MAGUIRE, had told the Stewards the resulting flat tyre had cost him a closer placing, but Stewards felt the horse had probably run its race.

Submissions for Penalty:

Mr Ydgren said the Stewards note the JCA penalty guidelines for a driver hitting a wheel, is 6 drives or a $300 fine. He said a slight uplift was warranted for puncturing a horse’s tyre that was in contention. He added they also felt Mr Wilmott deserved some concession for his admission, good record and his cooperation. The Stewards asked to consider a $250 fine as penalty.

Reasons for Penalty:

In determining penalty, the Committee considered this to be a mid-range breach with an aggravating factor of flattening the leading horse’s tyre who may or may not have finished closer than fifth placing.

The Mitigating factors are Mr Wilmott’s good record and admission of the breach.

The Committee considered that a fine of $250 is an appropriate penalty in this case.
