Decision:

In exercising our discretion to relegate BURANO to behind SUPERSTAROURWISHES we are satisfied that the progress of SUPERSTAROURWISHES was affected and, had Mrs Barclay been able to take the run in the passing lane to which she was entitled under passing lane regulation 4, she would have finished ahead of Mr Williamson.

Amended placings are:
1st MOTU YOUNG JACOB
2nd SUNNIVUE TED
3rd ZEALOUS LADY
4th SUPERSTAROURWISHES
5th BURANO

Facts:

Mrs Williams, stipendiary steward, alleged that in the home straight BURANO (N Williamson) drifted into the passing lane impeding the progress of SUPERSTAROURWISHES (K Barclay).

Judge’s placings were:
1st MOTU YOUNG JACOB
2nd SUNNIVUE TED
3rd ZEALOUS LADY
4th BURANO
5th SUPERSTAROURWISHES
The margin between 4th and 5th was a long neck.

Submissions for Decision:

Mrs Williams demonstrated that shortly after straightening for the run home BURANO, which was leading, drifted into the passing lane. Mrs Barclay, who was trailing BURANO, was unable to make a run in the passing lane and she elected to move to the outside of BURANO for her run. Mrs Barclay then received only a chequered run to the line but in so doing SUPERSTAROURWISHES got to within a long neck of BURANO. Mrs Williams said she believed this had cost Mrs Barclay 4th placing, due to the narrowness of the margin.

Mrs Barclay gave evidence that she was trailing BURANO when they entered the home straight for the last time. She said she had been denied a run when BURANO drifted into the passing lane. She said she hesitated briefly and then elected to move to the outside of that horse to obtain a run. She believed this had cost her 4th placing.

Mr Williamson said BURANO had only shifted in briefly after he had "pulled the cord" and that he was never fully in the passing lane. He demonstrated on the video that he believed there was still room for Mrs Barclay to move into the passing lane once he had straightened BURANO. This was demonstrated, he said, by the horse following Mrs Barclay (ZEALOUS LADY) getting a passing lane run. He said he did believe his actions had cost Mrs Barclay the margin of a long neck.

Mrs Barclay then acknowledged she had been quick to elect to move to Mr Williamson’s outside and said she was now aware she would have got a run had she not moved wider on the track.

In reply, Mrs Williams demonstrated on the video that she was still of the view there was initially no run for SUPERSTAROURWISHES in the passing lane and that that horse was entitled to the run immediately on straightening.

Reasons for Decision:

Passing lane regulation 4 provides:

In the last lap of any race the leading horse on the running line shall, upon entering the home straight, maintain as straight a course as possible parallel to the running line and allow the trailing horses full access to the expanded inside lane.”

BURANO was the leading horse into the home straight. That horse was required to maintain as straight a course as possible parallel to the running line and allow the trailing horse, in this case, SUPERSTAROURWISHES, full access to the passing lane. This BURANO did not do. As a consequence, Mrs Barclay was forced to make her run on the outside of that horse. She lost ground and momentum through having to change ground and she also found that the gap that she was moving into was gradually closing as she progressed.  Mrs Barclay’s horse continued to make ground on BURANO and was only a long neck from that horse at the finish.
