GEORGE was therefore disqualified from its 5th placings.

The Official placings became:

1st - MASSIVE METRO

2nd - ONE OVER DA MOON

3rd - BRO FAWKES S

4th - CHARLEMAGNE

5th - SUNSET PEAK

Authority was given for payment of dividends and stakemoney in accordance with the above amended placings.

Facts:

Following the running of Race 8, the Fresher Foods Handicap Trot 2200m, a Protest was lodged by way of an Information. Mr Muirhead, Senior Stipendiary Steward alleged that the horse GEORGE, placed 5th, galloped the final 150m of the race in breach of the Breaking Horse Regulations.

Mr G Noakes, the trainer/driver of GEORGE and representing that horses connections noted the Information to the effect that :

(a) He did not wish to be present at the hearing, and

(b) He did not contest the protest.

Rule 870(3) states 'Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horse Regulations (b) provide that 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Submissions for Decision:

Using the films Mr Muirhead identified the horse GEORGE as it neared the 150 metres marker in the final straight. Just past that marker GEORGE went off-stride and galloped wildly until the finish. The horse finished in 5th place. Mr Muirhead submitted that the horse should accordingly be disqualified from the race.

Reasons for Decision:

The Protest was uncontested. The Committee were satisfied after viewing the films that the horse had breached the relevant Rule and Regulations.
