As Mr Harris admitted the breach the Committee found the charge proved.

Mr Harris was fined $200.

Facts:

Prior to the running of race 3, John The Spanner Hannah 1400, an Information was filed pursuant to Rule 330(3)(a). The Informant, Mr Jones, alleged that Mr T Harris broke a riding engagement when failing to seek a release from QUANTUM.

Rule 330(3)(a) provides:

(3) A Rider shall not:

(a) wilfully or without reasonable cause break a riding engagement

Mr Harris did not attend today’s race meeting and he told Mr Jones via mobile phone that he had no objection to this Information being heard in his absence. Mr Jones endorsed the Information "I do admit the breach" on behalf of Mr Harris.

Mr Jones advised the Committee that on the 14th of August he was contacted by NZTR who informed him that Mr Harris would not be riding at Te Aroha. He said Ms Nicholson, the trainer of QUANTUM had been advised that Mr Harris would not be riding at Te Aroha. Therefore she rung NZTR to replace Mr Harris with Mr M Cameron. He added that Mr Harris failed to contact the Stipendiary Stewards as to why he was breaking his riding engagement.

Mr Jones further advised that on the 15th of August he rang Mr Harris and his explanation was that he had only 1 ride. Mr Jones said that was not a sufficient excuse to break his riding engagement especially given that his residence is just 30 minutes away.

Submissions for Penalty:

Mr Jones said that Mr Harris admitted the breach and he has a clear record under this Rule. He submitted a fine in the vicinity of $150 to $200 would be appropriate.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The JCA Penalty Guide starting point is a $200 fine.

Mr Cameron was the replacement rider of QUANTUM.

The Committee has no evidence placed before it to deviate away from the starting point.
