Mr Johnson admitted the breach and we find the charge proved.

Mr Johnson is suspended from the conclusion of racing on the 15th September up to and including the 26th September 2019 (7 days).

Facts:

Following the running of race # 5 the Harcourts Dunedin Melbourne Cup Day Maiden 1600m an information was lodged alleging that Mr C Johnson was in breach of r 638 (1) (d) “…as the rider of Pushyaluck permitted his mount to shift inwards near the 900 metres when not sufficiently clear crowding Gerry Joyce onto Walk With Kings.”

Rule 638 (1) (d) reads:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless.

Mr Johnson appeared at the hearing and admitted the charge.

Mr Oatham, with the aid of the video replays, pointed out the relevant positions of the runners approaching the first turn. He stated Pushyaluck (Johnson) was crossing over from wider out as the field approached the 900m mark. He said Mr Johnson allowed his mount to shift inwards when not clear of Gerry Joyce (K Mudhoo) which in turn shifted inwards crowding Walk With Kings (R Beeharry). Both jockeys were forced to restrain their mounts. He said Mr Johnson did eventually relieve the pressure on the inside runners.

Mr Johnson stated Pushyaluck raced greenly in the early stages. He said as he moved forward to cross over he felt Pushyaluck had “knocked off” for a stride and shifted inwards. He admitted he was at fault.

Mr Davidson said Mr Johnson had five previous suspensions inside the past 12 months. Four of those were last year while the most recent was at Ashburton in May this year. However, he said Mr Johnson had had 613 rides since January 1st this year. He said the interference was mid-range and sought a suspension of eight days.

Mr Johnson stated he had declared rides at Awapuni on Saturday and did not seek a deferment.

Reasons for Penalty:

Mr Johnson admitted a charge of careless riding. The level of interference was mid-range given that two horses suffered interference although neither horse’s chances were unduly affected. Stewards sought an eight day suspension given Mr Johnson’s previous record inside the past 12 months. While Mr Johnson has five previous suspensions inside 12 months he only has one suspension since January 1st from 613 rides. He also admitted the breach at the outset. We take a starting point of eight days and give Mr Johnson credit for his guilty plea and his good record since January 1st this year. As riding engagements have closed any suspension will start from the conclusion of racing at Rotorua on the 15th September.
