The protest was upheld, and “WASHINGTON EXPRESS” was relegated from 4th to 5th place.

The amended places are as follows:

1st – Supabet (6)
2nd – Machs Gladiator (1)
3rd – Flyin Francis (11)
4th – Tinted Field (5)
5th – Washington Express (12)
6th – Lima Lass (10)

There was a direction that dividends and stake money be paid according to the amended placings.

Facts:

Following the running of Race 10, the Midlands Seeds Ltd Mobile Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren pursuant to Rule 870(5) against the 4th placing of “WASHINGTON EXPRESS” (12). It was alleged that this horse was in a break when crossing the finishing line, and was lapped on by another runner.

The Judge’s official placings in this race were as follows:

1st – Supabet (6)
2nd – Machs Gladiator (1)
3rd – Flyin Francis (11)
4th – Washington Express (12)
5th – Tinted Field (5)
6th – Lima Lass (10)

The Information reads as follows:

"I the above named informant allege that horse number (12) or its driver breached the provisions of Rule 870(5) (in that) your horse WASHINGTON EXPRESS galloped over the finishing line when lapped on by TINTED FIELD.”

Rule 870(5) provides as follows:

“(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.”

Mr L. R. Hanrahan, the trainer of “WASHINGTON EXPRESS” represented the interests of that horse, and he had written on the information “I do not contest the relegation of WASHINGTON EXPRESS”.

Submissions for Decision:

Video coverage of this incident was shown to illustrate that close to the finish of this race “WASHINGTON EXPRESS” had broken from its correct gait, and was still in a break when it reached the finishing line. At the finishing line “WASHINGTON EXPRESS” was lapped on by “TINTED FIELD” (5).

Mr Ydgren made submissions that “WASHINGTON EXPRESS” should be relegated to 5th place behind “TINTED FIELD”.

Reasons for Decision:

We were satisfied that this protest was not contested and that “WASHINGTON EXPRESS” should be relegated from 4th to 5th place.
