Facts:

At the conclusion of race 4 the Cox Family Special Handicap Trot information A6126 was filed by Stipendiary Steward Mr N Ydgren instigating a protest into the fourth placed horse by the judge, under rule 870(5), alleging that MARTINI (D O’Connell) broke over the finishing line and was lapped on by PERFECT SUNRISE (J Cox) MIRI (B Barclay) and BURANO (N Williamson).

The rule reads (870) (5):

Notwithstanding the provisions of sub rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait, shall be placed by the Judicial Committee behind such horse or horses provided that were such first mentioned first mentioned horse, is not in its correct gait as a result of interference to such a horse or its horseman , then (subject to rule 869(B) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr O’Connell (MARTINI) did not contest the protest.

Submissions for Decision:

Stipendiary Steward Mr N Ydgren stated that MARTINI had sat parked in second placing entering the home straight on the last occasion, and about the 30 metre mark from the winning post broke and was out of its gait to the winning post.

PEREFCT SUNRISE, MIRI, and BURANO were lapped on.

Mr Ydgren used the video clip of the incident to highlight his observations.

Reasons for Decision:

As MARTINI was clearly lapped on by PERFECT SUNRISE, MIRI ,and BURANO the Committee in accordance with rule 870(5) determined that MIRI be relegated from fourth placing to seventh placing.
