As Miss Taylor admitted the charge the committee find the charge proved.

Penalty:

Miss Taylor is fined the sum of $350.

Charge:

That apprentice Jockey Miss A Taylor used her whip excessively prior to the 200m. Rule 638(3)(b) was read and confirmed.

Facts:

Mr Goodwin presented video coverage of Miss Taylor riding Bella Carolina in Race 7 prior to the 200-metre mark. The footage clearly shows Miss Taylor striking her horse at least 15 times with a break of only one stride prior to the 200-metres, which is clearly outside the guidelines of hitting the horse six times then putting the whip away for six strides before using it again. All other riders in this race complied with the rule. Mr Goodwin emphases Bella Carolina did go on and win the race.
Mr Searle and Miss Taylor indicated it was an error of judgement and perhaps a case of over excitement.
Rule 638(3)
A Rider shall not: (b) strike a horse with a whip in a manner or to an extent, which is unnecessary, excessive or improper;
‘In this case excessive’.

Submissions for Penalty:

Mr Goodwin had concerns that this may have been an error of judgement, but asked the committee to take into account that this may seem by some, that an unfair advantage may have been gained by this incident as Miss Taylor has gone on and won the race. Although this is the first occasion Miss Taylor has breached this rule a fine between $300 and $400 would be appropriate.
Mr Searle asked the committee to consider the very good riding record of Miss Taylor who has only been riding for two years and what was excitement or misjudgement it was not with intent.

Reasons for Penalty:

The committee have carefully viewed the films shown and considered all the evidence presented. Mitigating factors show this is Miss Taylor’s first offence under this rule in two years of riding, and an early admission to the stewards is to be taken into account. With a starting point of $300 for a first offence, the aggravating factor in this incident appears greater with only one stride of respite breaking at least 15 strikes with the whip. This could be seen as Bella Carolina gaining an unfair advantage when being ridden outside the guidelines recommended prior to the 200 metres. While Miss Taylor was in a prominent position at the two hundred-metre pole Bella Carolina did go on and win the race. Taking all the above into consideration a monetary penalty will be imposed.
