Decision:

We are satisfied that each of the horses was denied a fair start and in accordance with r 213(i)(j) that this occurrence materially prejudiced the chances of each horse. After we so ruled, the stipendiary stewards declared SHAK’N CULLEN, IN THE KITTY, JANGO FETT, THE WRATH OF ROBYN and CHAR DO NEIGH to be late scratchings.

Facts:

After the running of race 8, the OTAUTAU FOUR SQUARE SUPERMARKET WAIRIO CUP (HANDICAP PACE), Mr Allison, Stipendiary Steward, sought a ruling pursuant to r 213(1)(j) whether the horses SHAK’N CULLEN, IN THE KITTY, JANGO FETT, THE WRATH OF ROBYN and CHAR DO NEIGH were denied a fair start.

Rule 213(1)(j) states:

A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

Submissions for Decision:

Mr Allison demonstrated on 2 video angles, the side-on and front-on, that SHAK’N CULLEN, which had drawn 6 on the front-line was side on both before and at the time the tapes were released. The horse was also rearing up and IN THE KITTY, which was standing on the front-line to the inside of SHAK’N CULLEN, shied away from SHAK’N CULLEN. JANGO FETT and THE WRATH OF ROBYN ran into the back of IN THE KITTY and were briefly entangled. CHAR DO NEIGH was inconvenienced by the melee.

We heard from the drivers of four of the affected horses.

Mr Lee stated that his horse had swung sideways before the tapes were released and that he had been calling out for assistance, which had not been forthcoming. Mr Lee said his horse was still sideways and was rearing when the tape was released.

Mr Hunter said that he was aware Mr Lee was calling and that he was having difficulty with his horse. He said when SHAK’N CULLEN was sideways on, rearing and moving inwards towards his horse, IN THE KITTY first froze and then moved sideways away from SHAK’N CULLEN. He was confident that IN THE KITTY’s actions were simply a reaction to the movement from SHAK’N CULLEN.

Mr Larsen said when Mr Lee’s horse went sideways, Mr Hunter had no where to go and JANGO FETT, which was off the 10 metre mark, had run into IN THE KITTY and took no part in the race.

Mr Ferguson said he had to swing sharp left in order to avoid Mr Hunter and had to stop and take hold of THE WRATH OF ROBYN, which was off the 30 metre mark. He carried on for a short period before retiring the horse from the race.

The starter Mr Ward, said he was aware there was yelling before he let the field go but he was unsure who was calling out. He was aware SHAK’N CULLEN was sideways but he said horses were often sideways on before the tapes were released and would then straighten. He said he believed the trouble had occurred after he had released the tapes and that was why he had not called a false start.

Reasons for Decision:

We are satisfied that the race was started at a time when it was inevitable that interference would be caused to other horses through the position on the track of SHAK’N CULLEN. The video evidence is to the effect that not only was SHAK’N CULLEN and its cart sideways on prior to the start but the horse was rearing as the tapes were released. IN THE KITTY is motionless for a brief moment before moving sideways away from SHAK’N CULLEN. JANGO FETT and THE WRATH OF ROBYN, who were on handicap marks, had nowhere to go and JANGO FETT ran into the back of IN THE KITTY and THE WRATH OF ROBYN came to a stand-still. CHAR DO NEIGH avoided the pile-up but lost considerable ground in so doing.
