As Miss Comignaghi had admitted the breach, the charge was found proved.
Penalty:
Miss Comignaghi’s application for a deferment until after racing at Dunedin on 6 February was granted.
Accordingly, Miss Comignaghi’s Class A Jockeys Licence is suspended from the conclusion of racing 6 February up to and including 19 February. In addition, a fine of $500 is imposed.
Facts:
Following the running of Race 8, the Speights Timaru Stakes (Listed), an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Rider, Miss T Comignaghi, alleging careless riding in that she permitted her mount MEARA MAY to shift inwards near the 1100m when not sufficiently clear of SEVERINE which was checked.
Rule 638(1) (d) reads as follows;
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Miss Comignaghi had indicated on the Information that this breach of the Rules was admitted, which she confirmed at the hearing. Miss Comignaghi also confirmed that she understood the charge and the Rule it was brought under.
Mr Davidson gave evidence and used video coverage, with the assistance of General Manager of Stewards, Mr N McIntyre, to show that nearing the 1100m, MEARA MARY, ridden by Miss Comignaghi, was racing 3 wide with SEVERINE, ridden by Ms K Williams and HE KIN FLY, ridden by Mr J Lowry, racing on the inside of MEARA MARY. He pointed out Miss Comignaghi shift inwards when not clear of SEVERINE and HE KIN FLY, in an attempt to take up a position forward of those runners. As a result of this manoeuvre, Ms Williams had to check her mount severely. This incident also caused jostling to HE KIN FLY.
Miss Comignaghi stated that she had made an error of judgement.
Submissions for Penalty:
Mr Davidson stated that Miss Comignaghi had an excellent record with no breaches under this Rule over the previous 12 months. Mr Davidson stated that the carelessness was mid to high and submitted that a starting point of between a 5 to 9-day suspension be considered. He added that an aggravating factor was the status of the race being listed with a stake of $50,000.
Miss Comignaghi elected to make no submissions on penalty apart from requesting a deferment of suspension until after racing at Dunedin on 6 February 2021.

The JCA Penalty Guide provides, for a mid-range breach of this Rule, a 5 National day suspension and $500 fine, as a starting point. A high range breach starting point is a 9 National day suspension. This Committee also assessed this breach as mid to high range and accordingly adopted a 7 National day and $500 starting point. The aggravating factor in this case was the status of the race which warranted an uplift in penalty which we set at 1 day. Miss Comignaghi’s good record and frank admission warrants a combined discount which we set at 1 day. We therefore determined that a 7 National day suspension and $500 fine was appropriate.
