Facts:
An Information instigating a Protest was lodged by Stipendiary Steward Mr N Ydgren against the 3rd placing of horse number 9 BETTOR ARDEN (Driver D Butcher ) on the grounds that it galloped over the finishing line and was lapped on by the 4th placed horse, number 1 MACS CREATION.
Mr G Small the Trainer of BETTOR ARDEN was not present at the hearing but he had endorsed the information with the words " I do not contest relegation to 4th".
Mr Ydgren demonstrated the incident by use of the video films and showed where BETTOR ARDEN broke from it's gait close to the winning post and it continued in a gallop across the finishing line and was lapped on by MACS CREATION. Mr Ydgren also produced a copy of the photo finish which confirmed that BETTOR ARDEN had been lapped on.
