As Mr Cameron admitted the breach we found the charge proved.

Penalty:

Mr Cameron is suspended from the close of racing on Wednesday September 6th up to and including racing on Thursday September 14th. (Mr Cameron advised that he does not ride routinely in the South Island). Days included are:

8/9/17 - Waipa
9/9/17 - Auckland/Wanganui
13/9/17 - Matamata
14/9/17 - Taranaki

Facts:

Following the running of Race 6 (Hastings-Heart Of Hawke’s Bay 1300), an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that M Cameron (DEALS IN HEELS) permitted his mount to shift inwards shortly after the start hampering JESSIEGEE (J Parkes) and PROFILE (K Cowan) which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Cameron confirmed to the Committee that he understood the charge and that he admitted the breach.

Mr Goodwin explained the incident using the two available video views. The front on view showed the three horses named on the information in the starting gates alongside each other with Mr Cameron (DEALS IN HEELS) to the outside of JESSIEGEE and PROFILE.

Soon after the start Mr Cameron angled inwards when not the required distance clear of Mr Parkes (JESSIEGEE) dictating that horse inwards onto Ms Cowan’s mount PROFILE. As a result she was forced to take hold of her mount.

Mr Cameron said the films were clear and explained that he simply misjudged his distance and came across too quickly. He thought that Mr Parke’s was going forward and across with him and that Ms Cowan was also going to angle across towards the rail.

Submissions for Penalty:

Mr Oatham said Mr Cameron had a relatively good record with only two careless riding charges in the last 12 months;
30/9/16 - 4 days
26/12/16 - 6 days + $1000

He said today’s breach was below mid-range and submitted that a suspension in line with the incident be imposed.

Mr Cameron said over the last 5 years he averaged 900 – 1000 rides in a season therefore believed his record was a good one. He said the submissions in relation to penalty from Mr Oatham were reasonably fair and probably reflected the level of carelessness. Mr Cameron advised of riding commitments on Wednesday at Counties and said any suspension could start following that days racing.

Reasons for Penalty:

The Committee adopted a five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. As the field jumped from the barriers Mr Cameron assumed that the two horses immediately to his inside would roll inwards with him but accepted that he had angled in too sharply. The side on view showed the degree of resultant interference with Ms Cowan having to ease her mount slightly. In our opinion the degree of carelessness was in the low to mid-range and did not warrant any uplift on the 5 day starting point.

Mitigating factors were Mr Cameron’s admission of the breach and his very good record for which we allowed a one day discount and imposed a four day suspension.
