As Mr Geddes had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Accordingly Mr Geddes was fined the sum of $200-00.

Charge:

Following the running of Race 1, the Sim’s Bakery Handicap Trot, an Information was filed by Stipendiary Steward Mr N. G. McIntyre against Open Horseman Mr J. B. Geddes alleging a breach of Rule 869(2)(a) in that he used his whip excessively.

Facts:

The charge reads as follows.

I the above named informant allege that the above named Defendant committed a breach of Rule 869(2)(a) in that driver J. Geddes used his whip excessively on Dixie Commando in the run home, approximately 24 times.”

Rule 869(2)(a) reads as follows.

“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”

Facts:

Mr Geddes had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.

Stipendiary Steward Mr McIntyre gave evidence and used video coverage to show that Mr Geddes had used his whip on approximately 24 - 26 occasions in the run home.

Submissions for Penalty:

In relation to penalty Mr McIntyre advised that Mr Geddes had not previously breached this Rule, and as it was admitted he submitted that a fine of $200-00 should be imposed.

Reasons for Penalty:

We took into account that Mr Geddes had no previous relevant convictions and also that he had admitted the breach. Taking these matters into account, and also taking into account previous penalties imposed for similar breaches of this Rule, we were satisfied that a fine of
$200-00 should be imposed.
