As Mr Coleman admitted the breach we find the charge proved.
Penalty:
We grant Mr Coleman’s request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, Mr Coleman had his license to ride in races suspended for a period to commence after racing on 26 November and conclude after racing on 3 December 2014 (4 North Island days).
Facts:
Following the running of race 4, Campbell Tyson 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Coleman permitted his mount HILLSBOROUGH to shift inwards when not sufficiently clear of REBEL ROSE which was forced inwards onto PERFECT ROSE which was checked near the 300 metres.
Mr Coleman acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Davidson identified on the video films that when being ridden forward HILLSBOROUGH shifted into the rightful running line of REBEL ROSE. He said Mr Coleman was not the required distance clear and noted REBEL ROSE was also checked as a result of the incident.
Mr Coleman said his mount initially rolled out then back in and freely admitted he did not realise there were 2 horses on his inside. He added HILLSBOROUGH was having its first start in blinkers and raced greenly.
Submissions for Penalty:
Mr Oatham produced Mr Coleman's record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being on 3rd October which attracted a 4 day suspension. He said Mr Coleman had an excellent record for quite some time prior to September. He said the mitigating factors were Mr Coleman’s good record and the fact he was not aware there were 2 horses to his inside. He described the level of carelessness as low to mid – range.
Mr Coleman advised that he had upcoming engagements at Te Aroha on 26th of November, and sought a deferment to any proposed suspension.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Coleman’s admission of the breach and his overall good record in relation to this Rule. We assess the level of carelessness as low to mid – range. The Committee did raise concerns that this breach was Mr Coleman’s 3rd in the last 3 months. We note this is uncharacteristic because for the previous 2 years he had an unblemished record.
After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
