Facts:
Following the running of Race 9, the Wenham Grain and Seed 1600, won by the horse YOSSARIAN, ridden by Ms Schofer, Mr Goodwin presented an Information that Ms Schofer had offended against Rule 638(3)(b)(ii) in that she was guilty of a breach because her whip use before the final 100 metres was excessive in that it comprised 8 inflicted strikes prior to the 100 metre mark. Ms Schofer as an apprentice rider was assisted by Ms Clapperton, and confirmed that she understood the rule and admitted the charge.

Mr Goodwin advised that Ms Schofer has had one previous breach of this Rule since the revised guidelines were issued.
Ms Schofer had nothing to add.
Reasons for Penalty:
We make it clear that they are guides only to riders and not rigid rules applied irrespective of the circumstances of the excessive use of the whip, which may vary from case to case. The starting point under those guidelines for a second offence is a fine of $500. Whilst there may in some cases be uplifts for aggravating factors, none exist in this instance so as to justify or require any increase.
