The breach is admitted and accordingly the charge is proved.

Penalty:

This Committee orders that Mr Lammas's Rider's Licence be suspended from the conclusion of racing today up to the conclusion of racing on the 13th of July 2019. That is 6 National Riding days.

Facts:

Following the running of the RACING SUNDAY AUGUST 11 an Information was lodged by Senior Stipendiary Steward Mr M Williamson against Class A Rider Mr C Lammas alleging that Mr Lammas as the rider of CHAPEAU used his whip excessively prior to the 100 metres mark.

Rule 638(3)(b)(ii) provides : A Rider shall not ;

(ii) strike a horse with a whip in a manner or to an extent which is excessive.

The Guidelines with respect to acceptable use of the whip provide Rule:638(3)(b)(ii)  a rider may be penalised if their whip use is outside of the following guidelines :

Inside the final 600 metres of any race, official trial or jump-out a horse may be struck with the drawn whip up to 5 times after which the rider must cease their use of the whip for a minimum of 5 strides before striking the horse again with the drawn whip, with this restriction to apply prior to the 100 metres. The whip may then be used at the rider's discretion until the winning post is reached.

Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.

Submissions for Decision:

Mr Lammas was present at the Hearing and he acknowledged that he understood the Rule and the Whip Guidelines and that he admitted the breach.

Reasons for Decision:

Mr Williamson demonstrated the incident by use of the race films and showed where prior to the 100 metres mark Mr Lammas used his whip 9 times but there was only a pause of 3 to 4 strides. 

Mr Lammas agreed with the number of strikes and said that he miscounted.

Submissions for Penalty:

Mr Williamson said that this was Mr Lammas's third breach in the previous 12 months and therefore a suspension of 6 to 8 days was appropriate.

Mr Lammas accepted that a suspension would be imposed.

Reasons for Penalty:

The JCA Guidelines provide for a fine of $300 for a first breach. $500 for a second breach and a suspension of a Rider's Licence for 6 to 8 days for a third breach of this Rule in a 12 month period.

Mr Lammas has admitted the breach but that was inevitable given the clear film evidence. He has not paused for a sufficient number of strides although we accept that he miscounted. We believe that a suspension of 6 days is appropriate.

Mr Lammas was asked if he wished to have a deferment of his suspension but he advised the Committee that he would take it straight away.
