As Mr Mansour admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Mansour’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Mansour had his license to ride in races suspended for a period to commence after racing on 11 May and conclude after racing on 22 May 2019.

The 12 May race meeting at Invercargill was not included in the penalty because the declaration of riders had closed.

Facts:

Following the running of race 8, Matamata Post & Rails ITM 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Mansour permitted his mount ATA RANGI to shift inwards when not sufficiently clear crowding KAJINO inwards onto VILLA NINE near the 800 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Mansour said he understood the Rule and confirmed that he admitted the breach.

Mr Williamson demonstrated the incident using the available video footage. He identified that ATA RANGI was the widest runner when Mr Mansour allowed his mount to shift in when only ¾ of a length clear of KAJINO near the 800 metres. He said Mr Mansour shifted in 1 ½ horse widths which placed KAJINO in restricted room. As a result that runner was crowded inwards and VILLA NINE was hampered and lost ground.

Mr Williamson said that there was some contribution to the incident as HOLSTY was racing ungenerously leading up to the incident.

Mr Mansour said that he was happy racing in a 6 wide position and it was never his intention to better his position. He said that when he angled his mount inwards he had an inexperienced rider on his inside which contributed to the incident. He identified that HOLSTY was shifting out when he was shifting in.

Submissions for Penalty:

Mr Jones produced Mr Mansour’s record which showed 2 previous breaches under this Rule in the last 12 months. He said to Mr Mansour’s credit he admitted the breach. He described the level of carelessness as low to mid-range and a penalty in line with that would be appropriate.

Mr Mansour spoke to his Manager and advised the Committee that he had engagements at Rotorua on 11 May and any proposed suspension could start after that date.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

It was clear on the video films that Mr Mansour permitted his mount to shift in near the 800 metres when insufficiently clear to do so. As a consequence KAJINO was crowded inwards onto VILLA NINE which was checked losing ground. The Committee deemed the level of carelessness displayed by Mr Mansour was in the low to mid-range.

The JCA Penalty Guide starting point for low to mid-range carelessness is 7 national days which was adopted.

The mitigating factors were Mr Mansour’s admission of the breach and his reasonably good record. For these collective factors Mr Mansour was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
