Facts:

At the conclusion of the running of race 10 at Otaki, THE MATHER AND BAIN MILE, apprentice jockey D Mo represented by A Sharrock admitted a breach of rule 638(3)(6) in that he used his whip excessively in the home straight.

After confirming Mr Mo understood the rule Stipendiary Steward, N Goodwin showed the film of the breach. He pointed out Mr Mo's continual use of the whip from before the 200 metre mark until the finishing post. He believed Mr Mo showed no respite and pointed out that the horse THE GRADUATE went on to win the race.

Mr Mo had no comment but Mr Sharrock agreed the whip use was excessive and looked bad. He stated that this was Mr Mo's last race day ride in NZ as he was returning home to Hong Kong and obviously was excited when he realised he was going to win.

Submissions for Penalty:

Mr Goodwin confirmed that this was Mr Mo's first breach of the rule and did concede that the breach was above mid-range. Because Mr Mo was returning home he asked for a monetary penalty.

Reasons for Penalty:

The circumstances, the committee agreed, dictated that a monetary penalty was the only appropriate course of action. It was in the committee's opinion a breach well above mid-range. The horse was struck with little, if any respite, in the run to the line.

Mr Mo admitted the breach and even though it was his first breach of the rule a fine at the top end of the scale was deemed appropriate.
