Facts:
Following Race 6, an Information was lodged by Mr J Oatham alleging a breach of Rule 330(3)(c) in that J Riddell was unable to make the carded weight for JON SNOW (56.5).
Mr Riddell confirmed for the Committee that he admitted the breach.
Mr Oatham said Mr Riddell informed the Stewards two races prior that he would be unable to make the weight. He was approximately ¾ kilo over the carded weight.
Mr Forsman, the co-trainer of JON SNOW, told Mr Oatham that he engaged Mr Riddell to ride his horse at 56.5 kgs and he was not prepared to put on more weight than that. He had engaged Mr Riddell because he wanted a strong male rider for the colt. Mr Riddell was replaced by Ms D Johnson, whom Mr Oatham described as “a Group quality replacement”; however it was not ideal to be finding a replacement rider at short notice in a Group 2 race.
Submissions for Penalty:
Mr Oatham said Mr Riddell had a clear record over the last 12 months which was a credit to him considering he was not a natural lightweight rider. This charge would normally be dealt with by way of a minor infringement notice but due to the Group 2 status of the race Mr Oatham placed it before the Judicial Committee. He submitted that a monetary penalty in the vicinity of $250 - $300 was an appropriate penalty.
Mr Riddell told the Committee he had already ridden at 57kgs today but he didn’t ask Mr Forsman if he could ride half a kilo over (the carded weight) due to the fact it was a Group race. He rode at Moonee Valley last night and conceded he might have overdone his schedule by accepting the ride on JON SNOW. He landed in Auckland at 6am this morning, flew to Napier at 9:30am and went straight to the gym for an hour. He thought he had his weight under control.
Mr Riddell said, in his opinion, the horse lost nothing by having Danielle Johnson ride it. The winner won by 5 lengths and JON SNOW finished second, the placing it would have finished if he had ridden it himself.
Mr Riddell concluded by saying he was not proud of the fact he couldn’t make the weight and he should have been charged because he did not fulfil his obligations but he thought the submission on penalty by Mr Oatham was too harsh.
Reasons for Penalty:
In considering penalty the Committee took into account all submissions presented. If today’s breach had been outside of a Premier race day Mr Riddell would have been fined $100 under the minor infringement system. Mr Oatham instead placed it before the Judicial Committee for consideration due to the stake and status of the race.
Today’s race was Group 2 status with a stake of $100,000 and penalties are generally much higher in these “black-type” races. We believe that an increase from the standard $100 is warranted. Mr Forsman specifically wanted Mr Riddell’s skills and was forced to change rider at short notice. It was fortunate that a suitable replacement rider was available.
We did however have some sympathy for Mr Riddell’s position. He was not overweight for lack of trying and did everything possible to fulfil his obligation to ride JON SNOW at the correct weight. Mr Riddell has in the past struggled with weight issues so must be commended for his clear record over the preceding 12 months. Taking into account Mr Riddell’s admission of the breach, his genuine regret at not making the correct weight and all the other submissions it was our opinion that a monetary penalty at the lower end of the stewards’ submissions was appropriate on this occasion.
