As Mr Innes admitted the breach the charge was found to be proved.

Accordingly we fined Mr Innes the sum of $250.

Charge:

Mr Oatham lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that L Innes failed to make the weight for VOLKSWOOD.

Facts:

Mr Innes advised Mr Oatham prior to Race 6 that he was three quarters to one kilo over the carded weight for VOLKSWOOD. He was subsequently replaced on that horse by Mr Du Plessis but then he picked up the ride on SAVOUR THE MOMENT in the same race.

Mr Oatham said whilst this charge would normally be dealt with under the minor infringement system he placed it before the Judicial Committee due to the unusual circumstances surrounding the breach in that Mr Innes picked up another ride in the same race (SAVOUR THE MOMENT) therefore he had not lost a riding fee and the Stewards believed it should be dealt with differently to that of a normal minor infringement first offence.

Submissions for Penalty:

Mr Oatham produced Mr Innes’ record which showed four breaches of this rule in the previous year:

He submitted that a higher fine than the normal be imposed due to the circumstances as described and also due to the fact it was a significant race.

Mr Innes said he didn’t really want to accept the ride on VOLKSWOOD at 53kgs however Mr Howarth assured him he could ride half a kilo over. Unfortunately Mr Innes said when he went to weigh himself he was three-quarters over.

Reasons for Penalty:

The committee considered all of the submissions and in coming to a decision on penalty we took into account the Listed status of the race, the fact that Mr Innes picked up another ride and therefore did not lose a riding fee and his record which we considered only average.
