Decision:
Accordingly and for the above reasons we are not satisfied that SAVABILL would have beaten ESTRATO if interference had not occurred. Therefore the protest is dismissed and the judge's placings shall stand.
We order the dividends and stakes to be paid in accordance with the result.

The margin between first and fifth was 2 lengths.
Following race 3 a protest was lodged pursuant to rule 642 (1). The informant Mr Innes alleged ESTRATO placed first by the judge interferred with the chances of SAVABILL placed fifth by the judge. The interference is alleged to have occurred near the 500 metres.
Submissions for Decision:
The informant Mr Innes demonstrated the video films and pointed out to the hearing Miss Spratt riding ESTRATO continue to ride out from the 500 metre mark taking his line in doing so. He said this went on for 150 metres and his horse was not able to get balanced which he belieived cost him winning the race.
Mr Sargent confirmed what Mr Innes had said.
Miss Spratt admitted she hooked off for a run which she was entitled to do at the 500 metres. She said Mr Innes rode into her trying to pocket her but she held her line.
Mr McKay said he had told Miss Spratt to be 1 off the rail which in the circumstances she was entitled to do. He said Mr Innes was trying to push her back in.
Mr Oatham when asked for his submissions said the videos were inconclusive but a relevant factor was that the incident occurred 500 metres from the finish. He believed therefore it was difficult to say if SAVABILL would have beaten ESTRATO if interference had not occurred.
Mr Innes in summing up confirmed his earlier statement.

The committee reviewed the video films and carefully considered the evidence. As stated above the alleged interference was 500 metres from the post which is an important fact to consider. At this stage both horses were beside one another with Mr Innes riding hard with the whip and not gaining ground. We believe Miss Spratt held her line with Mr Innes trying to force her in. ESTRATO then finished strongly being some 2 lengths ahead of SAVABILL at the finish.
