As Mr Johnson admitted the breach the committee deemed the charge proved.

Penalty:

Mr Johnson is suspended from the close of racing on 5 July 2018, up to and including 14 July 2018 - 5 National Days.

Facts:

Following the running of Race 4, the Iplex Maiden 2200, an Information was filed by Stipendiary Steward, Mr Goodwin, against Mr Johnson in that he allowed his mount, OUR MATRIARCH, to shift inwards when not clear of RHETT BUTLER which clipped a heel and blundered near the 1800 metre mark from the finish line.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Johnson acknowledged that he understood the Rule and signed the Information that he admitted the breach.

Mr Balcombe demonstrated the race films as the field approached the winning post on the first occasion. He identified OUR MATRIARCH, out wide after starting from the outside barrier, and RHETT BUTLER in the three wide line. Mr Balcombe said at approximately the 1800m point Mr Johnson looked across and angled his mount in towards the inside and clipped a heel of RHETT BUTLER.

Mr Johnson agreed with the Stewards’ assessment and said he had looked across and thought there was room to slot in closer to the inside, but there was a slight misjudgement on his part. He added it appeared as if Mr Singh was about to ease back, but he didn’t, making things tighter than he had anticipated. Mr Johnson said he heard no rider call out to him when crossing.

In answer to a question from the Committee, Mr Johnson believed he was “about 1-1/2 lengths behind Mr Singh when he crossed.

Mr Oulaghan submitted OUR MATRIARCH was racing erratically and pulling for its head at the time and track conditions were “pretty rough”, making judgement calls more difficult to execute.

At this stage of the hearing Mr Singh, the rider of RHETT BUTLER, was called to give evidence and confirmed his mount had clipped a heel, causing his horse to dip a little, but not badly.

Submissions for Penalty:

Mr Goodwin said Mr Johnson’s riding record included three low-end careless riding suspensions in the previous six months, the most recent at Awapuni in March 2018. Each resulted in four National day penalties being applied.

He said in the view of Stewards, the interference was at the low-end range of carelessness and Mr Johnson has seen a genuine spot to slot in and is close to being clear, but unfortunately this time he has caused RHETT BUTLER to clip a heel.

Mr Johnson and Mr Oulaghan sought a deferment of 7 days to start after the Wanganui meeting on July 5th, 2018 if the penalty is a term of suspension.

Reasons for Penalty:

Mr Johnson has come across from out wide out near the 1800m mark to slot in closer into the rail, but in doing so has clipped a heel which confirmed that he was not his and one other length clear of RHETT BUTLER, the required distance of his own mount’s length and one other clear when crossing another runner.

The Committee believes a period of suspension is an appropriate penalty.

The Committee assess the degree of carelessness to be at the low-end of carelessness and note that Mr Johnson’s mistake caused minimal interference.
Having regard for the JCA Penalty Guide the committee adopted a starting penalty point of 6 National days. We have taken into account Mr Johnson’s admittance of the breach and imposed a suspension of 5 National days suspension. There are no aggravating factors.
