Decision:

As Mr Ralph admitted the breach we find the charge proved.

Penalty:

Accordingly, we impose a fine of $600.

Charge:

Following race 9 an information was filed pursuant to Rule 614(2). The informant, Mr Oatham, alleged that Mr S Ralph omitted the lead bag when saddling ALFONZE.

Rule 614(2): A person must not be neglectful or careless in saddling a horse.

Facts:

Mr Oatham explained to the committee that Mr Ralph presented ALFONZE at the plate inspection prior to race 9. It was at this point Stipendiary Steward, Mr Robinson, observed the lead bag was missing. Mr Oatham told the committee that Mr Lammas the rider of ALFONZE had weighed out with the lead bag. Mr Ralph was then notified by the Stewards of the non compliance and the horse was re saddled with the correct gear in place.

Mr Oatham advised the committee that post race he weighed the lead bag. The total weight was 0.9kg.

Mr Ralph, in admitting the mistake, said a staff member had saddled up ALFONZE. However, he conceded that as the trainer he was responsible for their actions.

Submissions for Penalty:

Mr Oatham produced Mr Ralph’s record which showed he had 2 previous breaches under this rule in the last 2 years. These offences were for omitting a towel which resulted in fines. Mr Oatham said generally a fine of $500 was imposed in a situation like this. However, he did state that the stewards’ had discussion prior to today’s race meeting and were of the opinion that a $300 fine was an appropriate figure. Mr Oatham said an aggravating feature was this was Mr Ralph’s 3rd breach of this rule.

Mr Ralph when asked for submissions on penalty said any expense was tough to take within the industry.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. It was explained to Mr Ralph he was extremely fortunate Mr Robinson had identified that the lead bag was missing at the plate inspection. Because, had the horse finished in a dividend bearing place the consequences would have been far greater. The only mitigating factor is Mr Ralph admission of the breach. The clear aggravating factor is Mr Ralph’s poor record under this rule.

The JCA penalty sheet confirmed that the most recent fine imposed under this rule was $500 for a trainer with a clear record. The committee referred to the JCA penalty guide under this rule, which showed a starting point of $750 fine.

Balancing all the above facts we assess the appropriate penalty to be a $600 fine.
