Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 26 November and conclude after racing on 3 December 2017 (5 National riding days).
Facts:
Following the running of race 4, Harness Racing Waikato 20 January 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Ms Spratt allowed her mount EXPRESS CALL to shift in shortly after the start when not sufficiently clear of SEO LINN which was checked.
Ms Spratt acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson demonstrated the incident using the available video footage. He identified that Ms Spratt allowed her mount to shift in shortly after the start when only a length clear of SEO LINN. He said Ms Spratt got the margin slightly wrong which resulted in SEO LINN losing its line of running.
Ms Spratt accepted Mr Williamson’s interpretation of the incident.

Mr Coles produced Ms Spratt’s record which showed 3 previous breaches under this Rule in the last 12 months, the most recent being 1 November 2017. He said to Ms Spratt’s credit she admitted the breach, the level of carelessness was low and submitted a term of suspension would be appropriate.
Ms Spratt advised that she had engagements at Te Rapa on 26 November and sought a deferment to any proposed suspension.

The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage the Committee observed that Ms Spratt allowed her mount to shift in 1 horse width when only a length clear of SEO LINN. As a consequence of that shift Mr Nason, the rider of SEO LINN, was required to take a hold of his mount when checked. The Committee deemed the carelessness was low range.
The Penalty Guide for Judicial Committees recommends that the starting point for low range carelessness is 6 National riding days.
There were no aggravating factors.
The mitigating fact was Ms Spratt’s admission of the breach and a 1 day discount was applied.
Ms Spratt’s record was considered to be average and a neutral factor.
